WARRANTY & LIMITATIONS OF LIABILITY

Conbraco Industries, Inc. warrants, to its initial purchaser only,that its products which are delivered to this initial purchaserwill be of the kind described in the order or price list and willbe free of defects in workmanship or material for a period oftwo years from the date of delivery to you, our initial purchaser.Should any failure to conform to this warranty appear withintwo years after the date of the initial delivery to our initialpurchaser, Conbraco will, upon written notification thereof andsubstantiation that the goods have been stored, installed,maintained and operated in accordance with Conbraco’srecommendations and standard industry practice, correct suchdefects by suitable repair or replacement at Conbraco’s ownexpense.THIS WARRANTYIS EXCLUSIVE AND IS IN LIEU OF ANYIMPLIED WARRANTYOF MERCHANTABILITY, FITNESS FORAPARTICULAR PURPOSE OR OTHER WARRANTYOFQUALITYWHETHER EXPRESSED OR IMPLIED, EXCEPTTHE WARRANTYOF TITLE AND AGAINSTPATENTINFRINGEMENT. Correction of non-conformities, in themanner and for the period of time provided above, shallconstitute fulfillment of all liabilities of Conbraco to our initialpurchaser, with respect to the goods, whether based oncontract, negligence, strict tort or otherwise. It is the intentionof Conbraco Industries, Inc. that no warranty of any kind,whether express or implied, shall pass through our initialpurchaser to any other person or corporation.
